By using Ductovia or submitting your contact information via a form belonging to a company that uses Ductovia, you agree to these Terms and Conditions. If you do not agree, you must not use the service or submit your information.
## 2. What is Ductovia?
Ductovia is a software platform (SaaS) used by companies to manage, qualify, and respond to leads (individuals interested in their products or services) that arrive via their own web forms or CRM. Ductovia is operated by Fluxovia.
## 3. Eligibility
This service is intended for individuals over the age of 18. If you submit your contact information via a form belonging to a company that uses Ductovia, you declare that you are at least 18 years old.
## 4. Consent to receive WhatsApp messages — Ductovia accounts
This consent applies to **Ductovia account holders** (our clients and their teams)—not to those clients’ leads. Ductovia does not send WhatsApp messages to leads; that part of the communication is handled by each client business using its own methods (e.g., email).
If you enable WhatsApp notifications in your account settings, you authorize Ductovia to send you operational account alerts via **WhatsApp**—for example, notifying you that there is a new lead pending review and approval on your dashboard.
– **Message frequency:** Varies based on your account activity (the number of new leads received); generally, you should not receive more than a few messages per day.
– **Charges:** Your carrier’s message and data rates may apply.
– **How to opt out:** You can reply **STOP** at any time to stop receiving these WhatsApp messages, or **AYUDA**/**HELP** for assistance. You can also disable this channel in your account settings. – Consent to receive WhatsApp messages is not a condition for using Ductovia; you may choose to receive these alerts solely via email or Slack.
## 5. Permitted Use
You agree to use Ductovia and interact with the companies using it in good faith, without submitting false information or using the service for fraudulent or illegal purposes.
## 6. Intellectual Property
The software, the “Ductovia” brand, and associated materials are the property of Fluxovia. These terms do not grant you any rights to them beyond the use described herein.
## 7. Limitation of Liability
Ductovia is the software platform used by the company to manage and respond to your inquiry; it is not the telecommunications carrier and is not liable for delays, delivery failures, or charges applied by your mobile carrier that are beyond its control. Fluxovia is not responsible for the content of messages sent by companies using the platform, beyond providing the transmission infrastructure.
## 8. Changes to These Terms
We may update these terms from time to time. The “Last updated” date at the top of this page reflects the current version.
## 9. Governing Law
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of law principles. Any dispute related to these terms shall be resolved in the state or federal courts located in Indiana. This applies regardless of the country from which you access the service or the country where the business that contacted you is located.
